Privacy Notice

The Personal Data Protection Act 2010 (the “Act”), which regulates the processing of personal data in commercial transactions, applies to My Care Concierge Sdn Bhd (“Company”, “our”, “us” or “we”). For the purpose of this written notice (“Notice”), the terms “personal data” and “processing” shall have the same meaning as prescribed in the Act.

1. Consent to Processing

This Notice serves to inform you that your personal data will be and/or have been processed by us or on our behalf and you hereby give your consent to the processing of your personal data.

If you are a corporation supplying personal data of your directors, shareholders and/or officers to us, please do ensure that you have obtained their consent and bring this Notice to the attention of your directors, shareholders and/or officers whose personal information you are supplying/have been supplied to us.

2. Personal Data Collected

Your personal data may include but not limited to your name, address, e-mail address, photograph, birth date, phone numbers, identification card and/or passport number, race, gender, bank details, lifestyle choices, language and/or communication channel preferences (collectively, “personal data”) and all other personal data we again collect from you on any subsequent occasion. Personal data may in some cases consists of “sensitive personal data” which refers to information relating to your health, medical information, political opinions, religious beliefs, etc. For the purposes of this Notice, both personal data and sensitive personal data are included in any use of the term “personal data”.

3. Purposes of Processing

Your personal data was or is to be collected and further processed for:

a)communicating with you;
b)to provide our services;
c)to provide related services;
d)processing of payment transactions;
e)to follow up or pursue any queries you make;
f)security and fraud prevention purposes;
g)internal record keeping;
h)our corporate governance;
i)administration purposes;
j)surveys and trend analysis;
k)academic research;
l)branding, communications and corporate affairs purposes which include publication in printing materials, website and/or electronic media as well as external parties’ printing materials and/or electronic media;
m)complying with any legal requirements; and
n)such other purposes directly related to the foregoing.

4. Sources of Personal Data

Your personal data was or is to be collected from forms (electronic or otherwise), including but not limited to emails, mobile applications, phone calls, referrals and all other documentation submitted by you to us, all other information that you may provide us from time to time, and from third parties.

5. Right of Access

You are more than welcome to request to have access to your data within our storage at any time. If you wish to do so, you may at any time, contact us and view your data within our storage. We shall do their best to grant you access where possible within twenty-one (21) days from your request has been received. However, where:

1.the identity of the data subject is unidentifiable from the information given;
2.the access impacts on the privacy of others;
3.the request for access is frivolous or vexatious;
4.the cost incurred is far too great;
5.there are confidential commercial information that may be disclosed in the process;
6.the Personal Data is with another data user and such data user are unable to comply;
7.there are existing or anticipated legal proceedings; or
8.such access can be denied under law or by a law enforcement agency

we may not be able to provide you with access to the personal data we hold about you. In the event that we deny and/or are unable to comply with your request for access, we will inform you the reason(s) of our denial and/or inability to comply.

Please note that in processing your request, we may charge you a reasonable fee as prescribed under the Personal Data Protection (Fees) Regulations 2013 or its amendment from time to time to cover any cost incurred by us.

6. Disclosure of Personal Data

We disclose or may disclose your personal data to companies within the My Care Concierge Group (including the holding company, subsidiaries, associated, related and affiliated companies as well as their subsidiaries, associated, related and affiliated companies, both local and international), whether present or future (collectively, “the Group”), third parties providing medical services which included but not limited to medical clinics, dental clinics, medical practitioners, hospitals, business partners or to any third party organisations or persons providing administration (including but not limited to cloud storage and maintenance of records) or other services to the Group, or involved in any corporate exercises undertaken by the Group, within or outside Malaysia, or for the purpose of fulfilling our obligations to you in respect of the Purposes.

7. Assistance with Third Party Data

We may require your assistance if the personal data relating to other persons is required to process your personal data for the Purposes and you hereby agree to use your best endeavours to assist us when required.

8. Accuracy of Personal Data

We strive to ensure that your personal data with us are accurate, complete and up-to-date at all times. If at any point in time you believe that any of the personal data of yours that we hold is inaccurate, incomplete or not up-to-date, you should immediately inform us with the correct, complete and accurate data. We will use all reasonable efforts to correct the data within twenty-one (21) days from the date we receive your request for correction.

9. Security of Personal Data

As we strive to protect your personal data, we limit the personnel that can access your data and the amount of data accessible by them. Only personnel that specifically requires your personal data may access it to carry out their business responsibilities. Our employees are at all times obliged to respect the confidentiality of and personal data held by us.

We take reasonable steps to keep your personal data secure and protect it from loss, misuse, or unauthorized alteration. Any of the personal data you electronically provide to us are stored on secure servers. We also maintain a reasonable physical security procedure to manage and protect the use and storage of records containing personal data.

10. Transfer of Personal Data

We may transfer your personal data to a place outside Malaysia and you hereby give your consent to the transfer.

11. Your Responsibility

You are responsible for ensuring that the information you provide us is accurate, complete, not misleading and is kept up to date.

12. Language

In the event of any inconsistency between the English version and the Bahasa Malaysia version of this Notice, the English version shall prevail over the Bahasa Malaysia version.

13. Deemed Consent

By continuing to engage with us, you shall be deemed to have read, understood and accepted the statements and terms herein and have irrevocably consented to us processing your personal data.

14. Revisions to This Notice

Our Notice may be revised from time to time. Where the Notice is revised, the revised Notice will be posted on our website Care Concierge (mycareconcierge.com) and/or communicated to you via any other means of communication deemed suitable by us. If you continue to use our services/products, you shall be deemed to have agreed to accept such changes.
